Beware, These Are Various Types of Land Fraud

JAKARTA, KOMPAS.com - Various modes of crime have been carried out to deceive landowners. Secretary General of the Ministry of Agrarian Affairs and Spatial Planning / National Land Agency (ATR / BPN) Himawan Arif Sugoto explained, there are a number of modes of land fraud. One way is to use girik or land certificates that can be used as proof of rights. "Just talk about it, the administration of the establishment has been disorderly, as in the kelurahan, the land and building tax office that used to issue girik did not issue a history," said Himawan at the ATR / BPN Ministry Office, Tuesday (2/25/2020). For example, girik that can be falsified. Himawan said, the perpetrators could have issued a girik that actually did not exist. One case occurred in Bekasi. A person producing fake girik armed with blanks remains to be filled. "In an empty land, just put the girik there, it turns out there is already a certificate. Then also be careful if we have land. Now there is a mode of empty land being sued by people," he said. Perpetrators can sue the original owner to the State Administrative Court (PTUN). Reflecting on this case, the court can pass a verdict or verdict without the presence of the defendant. "Decided without the presence of the defendant, it was stated who sued as the owner of the land," said Himawan. However, if BPN refuses to issue certificates, the perpetrators may sue again in court with a civil decision. If the claim is granted, then it can cancel the existing certificate. "Now these are modes too," he said. Other modes found were forged land certificates or forged power of attorney used to administer a replacement certificate. The perpetrator then uses the certificate or power of attorney to replace land ownership. Finally, the ATR / BPN Ministry and the Police succeeded in catching a syndicate of land mafia cases using fake certificate and illegal e-ID cards. The mode used is as if wanting to buy a house then certificates are exchanged with fake certificates by inviting a fictional notary. This fictitious notary then makes a KTP, NPWP up to an active account number. They even checked the certificate with the land office together with the victim. After being declared authentic, the offender then exchanged the certificate with a fake document that had previously been prepared. Then one of the perpetrators brought the original certificate to the moneylender. "Because this is planned, our mode of cooperation is with the police. That way we expect the community to be deterrent and not try to commit acts against the law," Himawan finished.
